Whereas,Government of Maharashtra vide Notification of Urban Department No.DCR-1090/RDP/UD-11,dated 20^th February 1991 has sanctioned the Development Control Regulations for Greater Mumbai, 1991, as a part of finalDevelopment Plan for Greater Mumbai which came into force with effect from 25^th March 1991.

          And whereas, Government of Maharashtra vide Notification of Urban Department No.DCR-1095/1209/CR-273/95/UD-11, dated 15^th October 1997 appeared in Maharashtra Government Gazette,dated 15^th October 1997 at page 104 to 113-A has sanctioned the modification to the D.C.Regulation Nos.33(10), 33(14) and 60 of the Development Control Regulations for Greater Bombay 1991 for implementation of Slum Rehabilitation Scheme, as a part of final Development Plan for Greater Mumbai which came into force from 15^th October 1997.

         And whereas, the Government of Maharashtra vide notification of Urban Department No.DCR.1095/1209/CR-273/95/UD-11 dated 30.11.2002 which appeared in Maharashtra Government Gazette dated 12/12/2002 at page 1480, 1481 has sanctioned modification to regulations 31(4)(a) and 59 of the Development Control Regulation for Greater Bombay 1991, for effective implementation of Slum Rehabilitation Scheme and which came into force with effect from 30.11.2002.

         And whereas, in the CRZ notification dated 19.2.1991 of the Ministry of Environment & Forests, Government of India, there is no restriction on height of the buildings which are otherwise permissible in CRZ-II areas as per privisions of CRZ notification of MOEF, Government of India.
And whereas, regulation 59 of Development Control Regulation for Greater Bombay 1991, specifically meant for Coastal Regulation Zone which permits construction of buildings in Coastal Regulation Zone, if otherwise permissible as per provisions of the CRZ notification dated 19.2.1991 of MOEF, Government of India.

         And whereas, the Government of Maharashtra vide notification of Urban Department No. TPB/4391/1681/CR-188/91/UD-11 dated 25/1/99 has sanctioned the modification to Regulation 31(1) of the said Regulations, for the purpose of its implementation to the buildings to be constructed under Regulation No.33(7), 33(8) & 33(9) of the said regulations.

         And whereas, the building requirements for building to be constructed under regulations 33(10) are similar to those applicable for buildings to be constructed under regulations 33(7), 33(8) & 33(9) & it is necessary to extend applicability of the said modified regulation no.31(1) dated 25-1-1999 also to the buildings to be constructed under Regulation no. 33(10) & 33(14) of the said regulations, for effective implementation of the Slum Rehabilitation Scheme.

        And whereas,GovernmentofMaharashtra vide Notification of Housing and Special Assistance Department, No.SRP-1095/CR-37/Housing Cell, dated 16^th December 1995 has appointed “Slum Rehabilitation Authority” (hereinafter refferred to as “the said Authority”) under the provisions of section 3-A of the Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971.

       And whereas, According to the provisions of section 2(19) of the Maharashtra Regional and Town Planning (Amendment) Act, 1966 the said Authority has been granted the status of the Planning Authority in respect of Slum Rehabilitation areas for the purpose of implementation of Slum Rehabilitation Scheme in Brihan Mumbai.

       And whereas, the said authority has been empowered to initiate modification of any part of,or any proposal made in the final Development Plan under the provisions of sub-section (1-B) of section 37 of the Maharashtra Regional and Town Planning Act, 1966 and to submit the same to the Government for final sanction (hereinafter referred to as “the said Act”).

        Now, therefore in consonance with the provisions of section 37(1-B) of the said Act, the said Authority invites suggestions and objections from the public on the said modifications withina periodof thirty days from the date of publication of this notice in the official Gazette.

        Copies of the said modifications (asper schedule given below) are available for inspection in the office of the said Authority for information and also in office of the Deputy Director of Town Planning, Greater Mumbai ENSA hutments, Azad Maidan, Mumbai 400 001, the Municipal Commissioner, Brihan Mumbai Municipal Corporation Mahapalika Marg, Mumbai 400001, the Additional Collector (Encroachment), Old Custom House, Mumbai 400 023, the Collector, Mumbai Island City, Old Custom House, Mumbai 400 023, the Collector, Mumbai Suburban District, Bandra (East), Mumbai 400 051, the Divisional Commissioner, Konkan Division, Kokan Bhavan, CBD Belapur, Navi Mumbai 400 614.

        Any suggestions/objections to the said modifications (as per schedule given below) shall be sent to the Chief Executive Officer, Slum Rehabilitation Authrotiy, Griha Nirman Bhavan, Vth floor, Bandra (East), Mumbai 400 051 within thirty days from the publication of this notice in the official Gazette. Suggestions/Objections received after the prescribed time-limit shall not be considered.
                                               SCHEDULE
 

1.)Modification to Regulation No.31 - The following provison shall be added below Regulation 31 (1) :-

“Provided however that restrictions on height spelt out in this regulation shall not be applicable for construction of buildings undertaken under regulation No.33(10) and 33(14) of these regulations for implementation of Slum Rehabilitation Scheme.

2.)Modification to Regulation No.31(4)(a) - Following words in Sub Regulation 4(a) of Regulation 31 dated 30.11.2002 shall be deleted:-“which are affected by Coastal Regulation Zone Notification dated 19^th February 1991, issued by the Ministry of Environment and Forests, Government of India”

3.)Modification to Regulation No.59 -Following words in proviso at Sr. No. (e) under Sub Regulation (2) (A) (ii) of Regulation 59 shall be deleted :-

“which are affected by Coastal Regulation Zone Notification dated 19^th February 1991, issued by the Ministry of Environment and Forests, Government of India”
